1. Introduction
Welcome to LocumPal. These Terms of Service ("Terms") govern your access to and use of the LocumPal platform, including our website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
LocumPal is a healthcare staffing platform that connects healthcare providers ("Providers") with locum healthcare professionals ("Locums") in the United Kingdom. The Service facilitates shift management, compliance tracking, attendance verification, invoicing, and communication between Providers and Locums.
2. Eligibility
You must be at least 18 years old and legally permitted to work in the United Kingdom to use the Service. Locums must hold valid professional registration with the appropriate regulatory body (e.g., General Optical Council, General Medical Council) and maintain current professional indemnity insurance.
3. Account Registration
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.
4. Provider Obligations
Providers agree to: (a) provide accurate shift details including dates, times, rates, and requirements; (b) verify the compliance status of Locums before confirming shift assignments; (c) maintain a safe working environment in accordance with applicable health and safety regulations; (d) process payments to Locums in a timely manner as agreed; and (e) provide accurate practice location data for geofencing purposes.
5. Locum Obligations
Locums agree to: (a) maintain valid professional registration and insurance at all times; (b) upload and keep compliance documents current on the platform; (c) arrive punctually for confirmed shifts and use the GPS check-in system; (d) provide professional services to the standard expected of their profession; and (e) notify Providers promptly of any inability to attend a confirmed shift.
6. Fees and Payment
LocumPal offers tiered subscription plans as described on our pricing page. Fees are billed monthly or annually as selected. All fees are exclusive of VAT unless stated otherwise. We reserve the right to modify our pricing with 30 days' notice. Payment terms between Providers and Locums are facilitated through the platform but are ultimately the responsibility of the contracting parties.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described therein. GPS location data is collected only during check-in and check-out events and is used solely for attendance verification purposes.
8. Intellectual Property
The Service and its original content, features, and functionality are owned by LocumPal and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without our prior written consent.
9. Limitation of Liability
LocumPal acts as a platform connecting Providers and Locums and does not employ Locums directly. We are not liable for the quality of services provided by Locums, the conduct of any user, or any disputes between Providers and Locums. To the maximum extent permitted by law, LocumPal shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
10. Termination
We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time by contacting us at [email protected].
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
